What is a Lasting Power of Attorney ‘LPA’
Lasting Powers of Attorney, which fall into two categories, one to deal with your Property and Financial Affairs and the other to enable decisions to be made regarding your Health and Welfare, give legal authority to one or more people to deal with your affairs and sign any documents, apart from a Will, on your behalf. Once your Lasting Power of Attorney has been registered with the Office of the Public Guardian, it can then be used at any time, either with your agreement or upon your Attorney obtaining a Medical Certificate that you are no longer capable of managing your affairs, but until that happens, you will be able to continue dealing with all your own affairs in exactly the same way as you have always done.

Why make a Lasting Power of Attorney?
- It means that you choose the person or persons who will manage your affairs, whether family, friend or a professional adviser
- You may wish to exclude certain people, including outside agencies such as Social Services, from being involved in your affairs.
- If you suffer some sudden incapacity, such as a stroke or heart attack, a registered LPA can be used immediately.
- In a Health and Welfare LPA you can specify what may be very personal wishes as to the sort of care you would wish to have in your own home, or in a Care Home or regarding decisions to be made in hospital about the sort of treatment that you would, or would not, wish to have.
- If you suffer some sudden incapacity without having made a Property and Financial Affairs Lasting Power of Attorney, your assets could be frozen for several months whilst, for example, a member of your family (and this may not be the person that you would have chosen) has to apply to the Court of Protection to be appointed as your Deputy. The process for this is more costly and takes longer to put in place.
